On November 17, 2022 Cavalry Offered the SUM of $ 5,000 PLUS Waiver of the Underlying Judgment they had already obtained in the amount of $ 13,084.23 if Evan Gutman would agree to a confidential general release and also dismiss his pending appeal. Thus, they were offering a total sum of about $ 18k in exchange for a dismissal of the pending appeal, along with Mr. Gutman’s willingness to remain “Silent” even though they had already won the case at the trial court level. Suffice it to say, that is rather unusual. And in any event, Mr. Gutman does not “Sell” his “Silence” particularly wtih respect to issues of significant public importance. Typically, winning parties (as Cavalry “currently” is at the trial court level) do not offer to pay large sums of money for dismissals of appeals. Mr. Gutman did not even respond to the Cavalry Written Offer, a copy of which is presented in the immediate below LINK. As of September 12, 2023, the Appeal remains pending.
